Terms for working with makseong: development services, the apps and the free tools. Our offering is for businesses, not consumers.

Who it’s for
makseong contracts with businesses. The offering is directed at companies and sole traders acting in a commercial or professional capacity, not at consumers.
What we agree on
Every engagement starts from a written scope: what is being built, what counts as done, what it costs and what is not included. That scope together with these terms is the agreement, and nothing said in a chat replaces it. Work outside the agreed scope is quoted separately before it starts.
Delivery and acceptance
Work is delivered against the agreed scope. You have ten working days from delivery to report anything that does not match it, and makseong corrects that at no extra cost. After those ten days the delivery counts as accepted. Problems reported later are handled as new work, unless they are makseong’s own fault in something already delivered.
Rights to the code
The code written for you is yours: exclusive rights to it pass to you once the engagement is paid in full. Two things stay outside that transfer. makseong’s own pre-existing components, tools and libraries remain makseong’s, and you receive a perpetual licence to use them inside the delivered work. Third-party and open-source components stay under their own licences. makseong keeps the right to name the work publicly in the form already published on this site, unless you ask otherwise in writing.
The free tools
makseong’s free tools (the store and feed scans) are automated, heuristic tools that read public store data and flag where information appears to be missing or at risk. They are configuration and automation guidance - not legal advice, they do not establish compliance, and they create no advisory or client relationship.
No certification or guarantee
makseong is not a certified or official compliance body. Results indicate potential issues only and reflect a point-in-time automated check; they do not guarantee acceptance by authorities or marketplaces. You remain solely responsible for your store’s compliance.
“As is”
The free tools are provided “as is”, without warranty of accuracy or completeness, to the extent permitted by law.
Liability
makseong is fully liable for intentional breach and gross negligence and for harm to life or health; liability of that kind cannot be excluded by agreement. Beyond that, total liability for an engagement is capped at the fees paid for that engagement, and the free tools carry no liability at all. Mandatory statutory liability is unaffected.
Invoicing and tax
makseong invoices as a sole proprietor registered in Ukraine and is not registered for VAT in the EU, so invoices carry no VAT. Business customers in the EU account for VAT themselves under the reverse charge; customers elsewhere handle their own local taxes.
Payment and refunds
Fixed-scope work is half before it starts and half before the finished work is handed over. Longer projects are split into milestones, each invoiced at its start, so no more than one milestone is ever outstanding. Ongoing work is invoiced monthly. Invoices are due within fourteen days. A prepayment reserves time in the schedule: if makseong has not started, it comes back in full; once work has started it is not refundable, and if you stop the project you pay for what was done and keep it. Work pauses on an overdue invoice, and rights to the code pass only once the engagement is paid in full.
Personal data
Where the work gives makseong access to personal data you control, makseong acts as your processor, on your instructions, and signs a data-processing agreement on request. What makseong processes for its own products is described in the Privacy Policy.
Governing law
These terms are governed by the law of Ukraine, and disputes are heard by the competent courts of Ukraine. This applies to business customers; makseong does not contract with consumers.
Changes
We may update these terms; the date above is the current version. The version in force when an engagement starts is the one that governs it.
